株式会社ウェルネス（以下「当社」といいます。）は、当社が提供するサービス「Wellness」、これに付随するサービス、及びその他当社が提供するサービス（以下併せて「本サービス」といいます。）における利用者様並びに、当社の役員・社員・アルバイト・派遣社員その他当社の業務に現に従事するすべての方、当社の役員・社員・アルバイトとして採用選考中の方、過去に採用選考を行った方、及び当社の退職者の方についての個人情報を含む利用者様の情報（以下「利用者情報」といいます。）の取扱いについて、次のとおりプライバシーポリシー（以下「本ポリシー」といいます。）を定め、本ポリシーに基づき適正に利用者情報を取り扱います。利用者様においては、本ポリシーにご同意いただき、本サービスを利用いただくものとします。なお、本ポリシーで利用する用語の意味は、個人情報の保護に関する法律（以下「個人情報保護法」といいます。）に準拠するものとします。

第1条（総則）

当社は、利用者情報の保護実現のため、個人情報保護法その他関連する法令やガイドライン等を遵守いたします。
本サービスに関連する当社以外の事業者が提供するサービス（第２条第4項に規定する他のサービスを含みますがこれに限定されません。）（以下「外部サービス」といいます。）については、本ポリシーの規定は適用されません。外部サービスにおける利用者情報の取扱いについては、外部サービスを提供する事業者が別途定めるプライバシーポリシー等をご参照ください。
当社が、当社の運営するウェブサイト上に掲載するプライバシーポリシーその他の個人情報保護方針又は利用規約等においてお客様情報の取扱いについて規定する場合、当該規定も適用されるものとし、当該規定等が本ポリシーと抵触する場合には、本ポリシーが優先されるものとします。

第2条（取得する情報）

当社は、本サービスにおいて、次に掲げる利用者情報を取得します。

利用者様にご提供いただく情報氏名、住所、郵便番号、性別、生年月日、電話番号、メールアドレス、アカウント（本サービスのアカウントに限定されず、業務提携先（本条②に定義します。）が提供するサービスのアカウントも含みます。）のID及びパスワード、クレジットカード情報、金融機関口座等決済手段に関する情報、病歴に関する情報、成育歴に関する情報、家族・住環境その他生活環境に関する情報、お身体の状況に関する情報、病状に関する情報、調剤に関する情報、健康診断の結果にかかる情報、保健指導の内容に関する情報等、及びその他本サービスの提供において必要となる当社が指定した情報等
利用者様が当社の業務提携医療機関等、業務提携企業、及び業務提携医療従事者（本サービスにおけるパーソナルドクターを含みますがこれに限定されません。）（以下併せて「業務提携先」といいます。）に対して当社への利用者情報の提供に同意した場合における業務提携先から提供される情報病歴に関する情報、成育歴に関する情報、家族・住環境その他生活環境に関する情報、お身体の状況に関する情報、病状に関する情報、調剤に関する情報、健康診断の結果にかかる情報、保健指導の内容に関する情報等
当社と利用者様が勤務する法人との契約に基づき利用者様が本サービスを利用する場合において当該法人から提供される情報氏名、メールアドレス、健康診断の結果にかかる情報等
利用者様が本サービスの利用に際して、他のサービス（「HealthKit」を含みますがこれに限定されません。）と連携を許可することにより、当該他のサービスからご提供いただく情報当該他のサービスで利用者様が利用するID等、その他当該他のサービスの設定等により利用者様が連携先（当社及び本サービスにかかるアプリケーションを含みます。）に開示を認めた情報等

第3条（利用目的）

当社は、利用者情報に含まれる個人情報を、次に掲げる利用目的（以下「本利用目的」といいます。）の範囲内において、取得及び利用いたします。

利用者様の認証・登録を行うこと、利用規約等に違反する利用者様への対応その他不正行為の防止、利用者様の利用状況を確認して行う調査及び各種必要な案内をすること、利用者様からの問合わせ、相談、苦情に対応することその他本サービスの運営に関する事項を円滑に行うため
利用者様の身体状況等や健康診断の状況等の確認を行い、カウンセリング、必要な情報提供、リマインダを行う等本サービスを適切かつ円滑に提供するため
本サービスの改善・不具合への対応、並びに、本サービスの提供、維持、開発、及び向上のため
利用者情報を分析し、個人を特定できないかたちで統計資料等を作成するため
本ポリシー又は／及び利用規約等の規定に従い、当社と利用者様が勤務する法人との契約に基づき利用者様が本サービスを利用する場合における当該法人や業務提携先等に利用者情報を提供するため
業務提携先又は他のサービスの提供者が保有する情報と連携を行うため
当社の本サービスの新たな機能、新たなサービスの開発・研究のため
本サービスの対価のご請求のため
当社から、当社の提供するサービス（本サービスを含みますがこれに限定されません。）及び当社が指定する第三者の提供するサービスに関連する、新機能、更新情報、キャンペーンその他の情報のご案内をするため
利用者様の興味・関心、属性等を分析し、利用者様に合わせたコンテンツ又は情報等を提供するため
業務提携先又は他のサービスの提供者から取得した個人情報と当社が保有する個人情報を突合し、突合した結果を、業務提携先又は他のサービスの提供者に提供し、若しくは、当社のサービスの提供に活用するため
当社のサービスの普及を目的としたモニターや取材対象者の募集のため
当社による広告宣伝、アンケートの実施のため
当社のサービスのマーケティング資料の作成及び提供のため
当社の採用選考、会社説明会、及びインターンシップその他の採用関連イベントの応募者に対する情報提供、応募者の採用選考手続き（採用選考手続きにおける必要に応じた連絡を含みます。）、応募者からの問い合わせ、採用業務管理のため

第４条（要配慮個人情報の取得）

第２条に定めるとおり、利用者情報は、医療・健康に関する情報が含まれる場合があることから、個人情報保護法の要配慮個人情報に該当する場合があります。この場合、当社は、利用者様より本ポリシーに同意を取得する方法又は個別に同意を取得する方法により、要配慮個人情報の取得に関する利用者様の同意を取得し、法令等の定めに従って適切な取扱いを行います。

第５条（第三者提供）

当社は、次に掲げる場合を除き、利用者情報に含まれる個人データを、あらかじめ利用者様の同意を得ないで、第三者に提供いたしません。

同意を得た場合本ポリシー又は／及び本サービスにおける利用規約等を通じて、あるいは個別的に同意を得て、個人データを第三者に提供する場合があります（当社と利用者様が勤務する法人との契約に基づき利用者様が本サービスを利用する場合において、当社から利用者情報のうち当該法人における福利厚生のため必要となる一定の情報を当該法人に提供する場合を含みますがこれに限定されません。）。
法令上の理由がある場合法令の定めに従って提供する場合、又は公的もしくは政府機関からの要求によって個人データの提供が必要になる場合に、個人データを第三者に提供する場合があります。
業務委託のために提供する場合個人データの取扱いを外部の事業者等に委託することに伴い、個人データを当該委託先に提供する場合があります。これには、本サービスの提供のため業務提携先に検査業務、カウンセリング業務等を委託する場合や、商品等のお届け等を事業者等に委託する場合が含まれます。利用者様による要請がある場合、利用者様から第三者への開示または提供を求められた場合に提供を行う場合（マイル積算のためのANA X株式会社への提供を含みますがこれに限られません。）があります。
本サービスの提供に必要な場合クレジットカード決済手続きにおける、決済代行業者へのクレジットカード番号等の提供など、当社の正当な業務の範囲内であって、利用者様の利益が侵害されるおそれのない提供を行う場合があります。利用者様による要請がある場合利用者様から第三者への開示または提供を求められた場合に提供を行う場合があります。
事業承継の場合合併その他の事由による事業の承継に伴って提供される場合があります。
当社は、第１号記載の利用者様の同意を得て、利用目的のため必要な範囲で、以下に定める外国にある第三者に利用情報を提供します。なお、当社は、本サービスを提供するために必要な範囲で利用者様の利用者情報を提供する場合において、本サービスの維持や改善・利便性向上等を図る必要があるところ、利用者様から利用者情報の提供についての同意を取得する時点では、最終的にどの外国にある第三者の提供するサービスを利用するかが未確定であり、当該利用者情報を移転する外国及び当該利用者情報の提供先を特定できません。

第６条（匿名加工情報）

当社は、次に掲げる場合を除き、利用者情報を、あらかじめ利用者様の同意を得ないで、第三者に提供いたしません。

当社は、個人情報保護法その他の法令及び「個人情報の保護に関する法律についてのガイドライン」その他のガイドラインを遵守して、匿名加工情報及び加工方法等情報（以下「匿名加工情報等」といいます。）の適正な取扱いを行います。
当社は、保有する匿名加工情報の全部又は一部を第三者提供いたします。第三者提供する匿名加工情報に含まれる情報の項目は次に掲げるとおりです。年齢（生年月）、性別、病名、病歴に関する情報（現病歴、既往歴等）、生育歴に関する情報（出生順序、学歴、就労経験等）、入退院に関する情報（入院期間、病棟等）、家族・居住環境に関する情報、生活・社会機能に関する情報、退院後の状況に関する情報（介護保険及び生活保護の利用状況等）、薬剤に関する情報（入院時薬剤量、退院時薬剤量等）、検査に関する情報（臨床検査値データ等）。但し、これらのデータのうち本人を特定し得る情報は含まれません。
匿名加工情報の提供の方法は、次に掲げるとおりです。 ① DVD などの記録媒体に保存し、授受の記録が確認できる方法での提供 ② 適切にアクセス制限・管理を行っているサーバを介した提供 ③ 上記の他、情報の漏えい、盗難等を防止するためのセキュリティ措置（暗号化やパスワード設定）が適切に講じられた方法で提供
当社は、自ら作成した匿名加工情報以外の匿名加工情報を取り扱うに当たっては、当該匿名加工情報の作成に用いられた個人情報に係る本人を識別するために、当該個人情報から削除された記述等、個人識別符号、若しくは匿名加工情報の作成において行われた加工の方法に関する情報を取得し、又は当該匿名加工情報を他の情報と照合いたしません。
当社は、第三者に対して匿名加工情報であることを明示し、安全管理措置を講じた上で、当該匿名加工情報を提供いたします。

第７条（安全管理措置）

当社は、利用者情報の漏えい、紛失、改ざん、不正アクセスなどの危険防止のため、合理的な保護措置を講じます。また、当社は、利用者情報の多くが医療・健康に関する情報というセンシティブなものであることを認識し、利用者情報の安全性を保持するため、社員にプライバシー及び安全性のガイドラインを伝達し、社内でのプライバシー保護対策を徹底しています。
当社は、利用者情報の取扱いを外部の事業者等及び業務提携先に委託する場合には、当該委託先が合理的な安全管理措置を講ずるよう、適切な管理のための指示・監督を行います。
当社が講じる安全管理措置については、第10条（お問い合せ）記載のお問合せ窓口までお問い合せください。

第８条（利用者情報の開示・訂正等）

利用者様から提供された個人情報に関する個人情報保護法に基づく開示、訂正、追加、削除又は利用停止等については、第10条（お問い合せ）記載のお問合せ窓口までお問い合わせください。遅滞なく回答いたします。なお、ご本人確認ができない場合、法令等により開示等を行う必要がない場合、情報の性質等により開示等を行う必要がない場合等においては、これらの手続を行うことができない場合があります。

第９条（本ポリシーの変更）

当社は、利用者情報の取扱いに関する運用状況を適宜見直し、継続的な改善に努めるものとし、必要に応じて、随時本ポリシーを変更することがあります。
変更後の本ポリシーについては、本サービス上又は当社の運営するウェブサイトでの掲示その他分かりやすい方法により告知します。変更後の本ポリシーは、当社が本サービス上又は当社の運営するウェブサイトでの掲示その他分かりやすい方法により告知した時点から適用されるものとします。

Wellness Corporation (hereinafter referred to as the “Company”) (hereinafter referred to as the “Company”) is a company that provides the ‘Wellness’ service, related services, and other services provided by the Company (hereinafter collectively referred to as the “Services”). As stipulated in Article 2, user information may fall under the category of Sensitive Personal Information under the Personal Information Protection Law because it may contain medical or health-related information. In such cases, the Company will obtain the consent of the user regarding the acquisition of personal information requiring special consideration, either by obtaining consent to this policy from the user or by obtaining consent individually, and will handle the information appropriately in accordance with the provisions of the law and other regulations.

Article 5 (Provision to Third Parties)

We will not provide personal data contained in User Information to any third party without obtaining the User's prior consent, except in the following cases:

We may also provide personal data where requested by the User, or where the User requests disclosure or provision of such data to a third party, including, but not limited to, provision to ANA X Inc. for the purpose of mileage accrual.
Where necessary for the provision of the Service, We may provide personal data where such provision is within the scope of our legitimate business operations and is not likely to prejudice the interests of the User, such as providing credit card numbers and other necessary information to payment processing service providers in connection with credit card payment procedures. We may also provide personal data where requested by the User, or where the User requests disclosure or provision of such data to a third party.
In the event of business succession, We may provide personal data in connection with the succession of business due to a merger or other similar event.
The Company does not provide User Information to the overseas third parties set forth below, without obtaining an individual's consent set forth in Item 1 in advance, and beyond the scope necessary for the achievement of the Purpose of Utilization. In addition, The Company provides User Information to the extent necessary to provide the Service, and given the need to maintain, improve, and enhance the convenience of the Service, at the time of obtaining consent from the User for the provision of User Information, the overseas third-party service that will ultimately be used has not been determined, and accordingly the foreign country to which such User Information is transferred and the recipient of such User Information cannot be specified.
